1. Acceptance of Terms
By downloading, installing, or using the WeCare application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
WeCare is a wellness monitoring application for Wear OS smartwatches that:
- Monitors health metrics (heart rate, steps) from watch sensors
- Detects potential fall events
- Provides location information to designated caregivers
- Sends alerts to caregivers via a web dashboard
- Enables SOS emergency alerts initiated by the wearer
3. Intended Use
WeCare is designed for:
- Elderly individuals who wish to share wellness information with family caregivers
- Care facilities monitoring residents with consent
- Family members providing remote care support
Consent Required: The person wearing the device must consent to monitoring. Installing WeCare on someone's device without their knowledge or consent is prohibited.
4. User Responsibilities
As a user of WeCare, you agree to:
- Obtain proper consent from the person being monitored
- Keep the smartwatch charged and worn as intended
- Maintain an active internet connection (WiFi or cellular) on the device
- Not rely solely on WeCare for emergency response
- Have alternative emergency plans in place
- Keep your account credentials secure
5. Limitations of the Service
You acknowledge and agree that:
- WeCare depends on device sensors which may not always be accurate
- Network connectivity issues may delay or prevent alert delivery
- GPS accuracy varies based on environmental conditions
- Fall detection may not detect all falls or may generate false alerts
- Heart rate monitoring is for wellness purposes only, not medical diagnosis
- The service may be interrupted for maintenance or technical issues
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, secure, or error-free
- The results from using the App will be accurate or reliable
- Any errors in the App will be corrected
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WECARE AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Personal injury or death
- Loss of data or privacy breaches
- Failure to detect or report emergencies
- Delayed or missed alerts
- Any damages arising from reliance on the App
8. Privacy
Your use of WeCare is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
9. Account Termination
You may stop using WeCare at any time by uninstalling the App. We reserve the right to suspend or terminate your access if you violate these Terms.
10. Changes to Terms
We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
